This User Agreement (“Agreement”) is a legal contract between Kifood LLC, and any individual or entity (“User”) accessing or using Company’s e-commerce platform, website, mobile application, or any other services offered by Company (collectively referred to as the “Service”).

By accessing or using the Service, User agrees to be bound by the terms and conditions of this Agreement. If User does not agree to these terms, User should not access or use the Service.

d. Harvest or collect email addresses or other contact information of other users from the Service for the purpose of sending unsolicited emails or other unsolicited communications.

e. Impersonate any person or entity, or falsely state or otherwise misrepresent User’s affiliation with a person or entity.

f. Violate any applicable laws or regulations.

5. **Intellectual Property:** The Service and its original content, features, and functionality are owned by Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. **Third-Party Links:** The Service may contain links to third-party websites or resources. User acknowledges and agrees that Company is not responsible or liable for the availability or accuracy of such websites or resources, or the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Company of such websites or resources or the content, products, or services available from such websites or resources. User acknowledges sole responsibility for and assumes all risk arising from User’s use of any such websites or resources.

7. **Disclaimer of Warranties:** THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. **Limitation of Liability:** IN NO EVENT SHALL COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO USER’S ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE.

9. **Indemnification:** User agrees to indemnify, defend, and hold harmless Company, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from or relating to User’s access to or use of the Service, User’s violation of this Agreement, or User’s violation of any third-party rights, including without limitation any copyright, property, or privacy right.

10. **Governing Law:** This Agreement shall be governed by and construed in accordance with the laws of China, without regard to its conflict of law principles.

11. **Dispute Resolution:** Any dispute arising out of or relating to this Agreement shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association.
